On-Site Catering Terms and Conditions

READ ME BEFORE ORDERING 

  1. Maximum number of pax per event must be observed, in accordance with the Metro Manila GCQ regulations.  
  2. Rate is inclusive of 12% Vat, Service and Catering Charge.
  3. All input fields must be filled up on the Cart page to secure a Reservation or a meeting with a Sales Representative. 
  4. Payment will be settled with a Sales Representative after Inquiry has been sent. Orders added to Cart will not be charged to the Guest until after the meeting with the Sales Representative. 
  5. Additional Fees may apply after the menu and other pertinent details have been finalized with a Sales Representative. 

 

ACCOUNT CREATION

 

By registering with this website, you are agreeing to provide your personal information and nominate a confidential password for your account. Should you believe that your password has been compromised, kindly change your password immediately. MomentFood reserves the right to suspend your registration, should you breach these Terms and Conditions.

 

ORDERS

 

These Terms and Conditions shall apply to all Inquiries of MomentFood products, the agreement to which will be considered as an offer to purchase the products in accordance with the said terms. 

 

Acceptance of Orders

 

All momentfood.com orders serve as Inquiries and are to be confirmed with a Sales Representative 5 days before the event. 

Cut-off for orders is at 7:00 PM daily. All orders made after 7:00 PM will be processed the next day. 

It is  Moment Catering’s entire discretion to accept inquiries from this website. Moment Catering reserves the right to decline the transaction without giving any reason. The receipt of the inquiries will render a transaction number and will be sent through the provided email address or mobile number, with complete order details.

 

Order Confirmation

 

The Order Confirmation will be after you have been contacted by a Sales Representative. It is an acknowledgement and record of the agreement to deliver the products ordered and within the specified delivery time.

Product availability and customer information will be done via a phone call to the customer to offer a reasonable substitute (if needed) and/or confirm information.

An accurate event address, email address, and contact number must be ensured when ordering to avoid any discrepancy or delays in fulfillment.

Should your account be used by another person on your behalf, transactions shall be considered as your own, and shall be subject to these Terms:

  

PRICES AND PAYMENT

 

Menu Prices

 

Unless otherwise stated in writing, the prices quoted on this website are inclusive of VAT, Service and Catering Charge. Additional Fees may apply after the menu and other pertinent details have been finalized with a Sales Representative. The vendor reserves the right to change the prices of products at any time without further notice. 

Without prejudice to any inadvertent technical mistake (which will be charged to the customer), the price of the product/s shall be as reflected on the website.

 

Payment

 

Payment will be settled with a Sales Representative after Inquiry has been sent. Orders added to Cart will not be charged to Guest until after the meeting with the Sales Representative. Full payment is required prior to the event. 

Payment can be done via Cash, Credit Card, Debit Card (VISA, Mastercard), or GCash. Kindly ensure card validity, should you choose to pay via Credit or Debit Card. The vendor reserves the right to cancel your order at any stage.

Cash and Online Credit Card Payments will be validated before the event and may be subject to additional delivery charges. For the protection of both credit card holders and MomentFood against fraudulent payments or use of credit, debit and charge cards, the vendor reserves the right not to fulfill if no credentials are presented.

The vendor reserves the right to refuse your offer, should it be necessary.

 

EVENT DETAILS

 

Number of Attendees

 

Maximum number of pax per event must be observed, in accordance with the Metro Manila GCQ regulations.  

The guaranteed number of attendees at each catered function must be communicated to the Catering Team-in-charge to your event not less than 5 full working days (Saturday through Thursday, excluding holidays) prior to the Event.  A Banquet Event Order will be completed and sent for each scheduled function.  A 10% allowance in food preparation and set up over the guaranteed number of attendees will be made on all catered functions/ outside catering comprising part of the Event.  Final charges will be based on the guaranteed number of attendees (or the number of persons for which the catered portion of the Event was originally booked, if no guaranteed number is provided) or the total.

 

Leftover Food

 

You shall hold The Moment Group free and harmless from, and compensate it for, any claims and  liability arising from any left-over food or any food items consumed outside the function room premises.  

 

Corkage of Outside Food and Beverage

 

No food of any kind can be brought into The Moment Group function space/services by the Patron.  No Beverages of any kind can be brought into the hotel by the patron without the written permission of The Moment Group and are subject to service fees and/or labor charges/ corkage as are deemed necessary by The Moment Group. The Moment Group shall not be held liable from any claims and liability of foodbornse illnesses when outside food and drink have been corkaged and have been requested to be served at the event. 

 

Ingress/Egress Agreement and Damage to Property (If Applicable)

 

The Moment Group does not permit any kind of carpentry, painting,  or floral preparation  works within its event venues . Stage, backrop, floral arrangement shall be either pre-fabricated, delivered, and only assembled  in our function rooms or prepared in the property's designated for prepartion and carpentry areas. 

All organizers shall be solely responsible and liable for any damages (chargeable directly and immediately to the organizer) and/or injuries, whether  personal or to property  and that the ORGANIZER'S guests and other persons attending the function, and the caterer's staff and employees,  may suffer by reason of, or arising out of the  activities undertaken during the event or materials and equipment brought in by the event. The ORGANIZER shall hold the caterer free and harmless and shall indemnify the latter from any claims and actions for the forgoing damages. The client shall shoulder damages to furnitures, fixtures and equipment that have been caused as a result of accidence or negligence on the part of the client and/or the client's/organizer's guests.

 

Postponement/Cancellation

 

If the Patron cancels the Event either partially or in it’s entirely, The Moment Group shall have suffered damages equivalent to the lost profits that The Moment Group would have made from the sale of the function venues, food and beverages, etc. in connection with the Event.  The Parties acknowledge that The Moment Group shall assess a fee against the Patron as liquidated damages and not as a penalty, such damage amount is agreed to be expressed as a percentage of revenue lost by The Moment Group as a result of the said cancellation, as reasonably determined by The Moment Group (The Fee).  

If the Event is canceled in its entirety, the Fee shall equal the amount calculated using the scale below. Cancellation Fee: % of Estimated Lost Food & Beverage Revenue, Venue rental:

 

90 - 46 days prior to the event 25 % of anticipated total banquet revenue 

45 - 31 days 50% of anticipated total banquet revenue 

30 -15 days 75% of anticipated total banquet revenue 

14 – 1 day 100% of anticipated total revenue

 

Should another client re-book the function venue/ service and date with a comparable function after cancellation by the Patron, all or a portion of the advance deposit and cancellation fee may be refunded to the Patron at the absolute discretion of The Moment Group.



OPERATING LICENSE

 

The Moment Group and its Management reserve the right to fully protect its operating license and will decline to continue service to serve any guest whose behavior may be considered to be impaired by any over indulgence in drinking. The Moment Group reserves the right to cancel a function if it has reason to believe that the exact nature of the event varies from the originally agreed upon, whether in writing or given verbally and/ or that the holding of such function may be against the law, public morals or public policy. In such case, The Mess Hall shall has the right to forfeit any and all deposit or down payment already received as and by law of penalty and liquidated damages.

 

FORCEMAJEURE

 

The Moment Group is hereby relieved of all liabilities by any form of damages caused by any accident, fire, earthquake, typhoon, strikes, lock out, vehicular accident, delay due to extra ordinary vehicular accidents, delay due to extra ordinary vehicular traffic, accidental fire at the venue or party and other uncontrollable events, which may affect the normal operations. The performance of this agreement by is subject to acts of God such as typhoons, earthquakes, fires, floods, or other disasters, and acts of man such as war, government regulations, strikes, civil disorders, curtailment of transportation facilities, or other emergencies making it inadvisable, illegal or impossible to uphold previous contractual agreements.

 

LEGAL STATEMENT

 

The CATERING.MOMENTFOOD.COM website is operated and managed by Moment Catering. This website is maintained for your personal use, viewing, ordering and delivery food online. Access and use of this website constitutes your acceptance of these Terms and Conditions.

 

DISCLAIMERS AND LIMITATION OF LIABILITY
